This article supports that the violations of human rights in Morocco are not the result of a cultural determinism, but rather the product of structures of power. Indeed, when the international reports concerning the reality of human rights classify Morocco among the least competitive countries in the world, in general, it surprises not much. Maltreatments perpetrated by this State contrary to its citizens go to the sense of popular beliefs. After all, as all countries of the region, Morocco lived under an authoritarian regime where the violations of human rights are rule rather than exception. Besides, some academics do not hesitate to explain this situation by arabo-Muslim culture. This one would be intrinsically incompatible with democratic values. Besides, others go to the point of dividing the globe between a despotic East and a democratic Occident. These same beliefs meet in the stories of the rights of the person. Until our days, these stories remain dominated by an eurocentrist vision of the world. Indeed, the common literature in domain locates the origin of these rights in Europe. According to this perspective, civil and political rights, such as they are admitted by Universal Declaration of Human Rights and international Pact relating to civil and political rights, scoop out their origin from Magna Carta. In this treaty dating of 1215, the king Jean of reconnait England of rights to powerful lords, among which the right to individual liberty, right not to be order in an arbitrary way and right not to be taxed in an excessive way. In a similar way, economic, social and cultural rights, such as they are promoted by Universal Declaration of Human Rights and international Pact relating to economic, social and cultural rights go back up to the social confusion caused by industrial revolution in Europe. Let us notice moreover that this eurocentrist vision of the world is accompanied in general by an Orientalist perception of the North Africa and of the Middle East. Orientalism defines itself as a hegemonic way to receive the altérité and to organise it into a hierarchy according to its rapprochement, or conversely to its distance of stocks and European institutions. And by adopting European identity as civilisationnel standard for all humanity, orientalism defines the altérité according to an one European, but more precisely an one idealised. So, as the Oriental would be despotic, as the Westerner would be democratic. Also, as the Oriental would be patriarchal, as the Westerner would be liberal. Consequences of this double eurocentrist and Orientalist vision of the world are tripartite. Above all, it emerges from it that there is history only European history. Same Marx, whose philosophy inspired many revolutionaries in the not Western world, thinks that the oriental societies are static, and that as a result, their only hope of connaitre the modernity would come from European colonisation. With such vision of the world, key historical events are received as being exclusively European. If that's how it is, between other examples, for industrial revolution, advent of economy of the market and individualism. In this respect, as mentioned before, human rights do not make exception. So probably anxious with being "politically correct", some academics raise the question of the pertinence of the application of basic rights in the not European societies. Others offer on the other hand to dissociate legitimacy and acceptance of the basic rights of their so-called European origin. In other words, if human rights are considered as European, they could be useful also in the not Western societies. Anyhow, this reducing perception of the world is more and more reappraised. Person wishing to adopt of postcoloniales approaches, several researchers have déconstruit the belief according to which there would be history only European history. It making, they showed successfully that our region of study lived in its own way, though often later that Europe, modernity with its lots of social confusion, such as: industrialisation, urbanization speeded up, advent of the economy of the market, luxation of traditional solidarities, penetration of the public and private spheres by commercial stocks and destabilization of the traditional roles between sexes. At the same time as these jobs which give again voice to the local populations of the North Africa and of the Middle East so that they rewrite their own history, recent researches in the field of human rights allowed to throw a new look on the origin of these rights. To celebrate the birthday of the Universal Declaration of Human Rights, among others, historian Paul Gordon Lauren decided to rewrite its history by consulting the archives of the United Nations which research the writing of this treaty over the years. These researches had the effect of showing that the small States participated, some more significantly than others, in his development. They had as merit to draw the attention of the researchers in the field of basic rights to the State presence representing forms of civilisation others than European civilisation in the international plan of the rights of the person. Further to jobs of Lauren, the political scientist Susan Waltz examined the archives of the United Nations which researched the writing of the international Charter of the rights of the person particularly interested in the role played by the small countries in this writing. Thanks to these researches, Waltz reaches déconstruire group of erroneous beliefs in the field of basic rights, of which between others the belief according to which Great Powers, further to their victory in World War II, would have conceived the international plan of the rights of the person, then been the burning defenders there, and conversely, the small States would have played it no role, or at most a passive role. Moreover, in an article which is exclusively interested in the Muslim States, Waltz goes a step farther by bringing back the contribution of the Muslim delegates in the international Charter of human rights. Between other examples, she names the article 3 of both pacts which owes its existence to the pleas of Badia Afnan, delegated Iraqi, and that demands that Member states assure an equality of rights between the women and the men. Finally, researching the central role played by the total South in the development of universal rights during the period of Cold War, recent jobs of the researcher Steven Jensen confirm the numerous origins of these rights. First, as the North Africa and the Middle East also contributed to universal rights, the origins of these rights are also in the history of these countries. Nevertheless, these stories are misread. And the rocking between the ignorance of the history of human rights in this region and the prominence granted in European history in the field explains the fact of some essentialisme in the field of basic rights. So, Occident is seen linking to progressive stocks, such democracy, human rights and principle of the equality of sexes. Conversely, the North Africa and the Middle East, all merged actors, are linked to backwardness, whose some demonstrations are cultural opposition to change, massive violations of human rights and the lower status of the women. The jurist Makau Mutua summed up well this essentialisme. He laments that the real speech of basic rights consists merely of the metaphor of the sauvage-victime-sauveur, where the wild – with his victims – would be a not Western State, while the rescuer would be the corpus of the basic rights the actors of which would be the United Nations, the Western governments, NGO international and other Western charitable institutions. However, as native of Morocco, I would be dishonest to pretend that descriptions of Hubbart and Benett suffer from eurocentrism and transport an Orientalist vision of Morocco, and by extension, of North Africa and of Middle East. And I would be even more abashed to plead for the cultural relativism in the field, and to try to find a glorious local explanation of such attacks in the dignity of the women. I share this idea therefore with the authors that street harassment is a retrogressive practice. Also, I share with them the point of view according to which the necessity for a woman to have a masculine companion, and more exactly a masculine guardian, to name things by their name, raises outright anachronistic medieval practices. But if I share with the authors their perception of a cultural opposition to change and of breaches of the modernity – defined here in terms of respect in the human dignity, of which of course that of women – in the social landscape of Morocco, I offer however to show in this article that it is not at all about a cultural tare which would be intrinsic in the country. In fact, in the present state of affairs, in Morocco, culture, traditions and religion are a political product. More precisely, it are the result discussed politics followed by a ruling elite which hoards the apparatus of the State, including the justice system. And when Justice is faulty, all kinds of violations of human rights can be perpetrated with impunity. Said more expressly, impunity plays a primordial role in the manufacture of the cultural opposition to change from which the Moroccan citizens suffer. But let us explain situation step by step. In anticipation, let us add that a monarchy governs Morocco. Although Constitution is amended in the context of the Moroccan uprisings of 2011, the king Mohamed VI still keeps all powers. Between others, he is the leader of the royal armed forces; he chairs the High Council of security; he has the almost all the power of the executive power; he chairs the High Council of judicial power; and he keeps the monopoly of the politics of human rights. Certainly, the Parliament is supposed to represent the will of the citizens. And on one hand, the king has the possibility of dissolving the Parliament any time. On the other hand, for a game of suppression, recovery and division, the monarchal institution succeeds in linking the majority to its objectives of the present actors on the political stage. In this context of concentration of power, ruling elite also keeps the monopoly of the definition of culture, traditions and of religion of the country. Let us remind in this respect that the king is the commander of the believers. Alas, the violations of cultural rights pass often unobserved. However, this elite instrumentalizes culture, official traditions and religion, with the intention of staying in power. As we offer to show it, political illiteracy programmes, deprivation of access to education and to knowledge, prohibition of the culture of human rights and the political acts of violence are so many mechanisms assuring the manufacture of the cultural opposition to change from which the Moroccan people suffer. Politics of illiteracy and of deprivation of education and of knowledge. In a research dedicated in Morocco, the anthropologist Paul Rabinow notices that the comparing of traditions is not modernity, but alienation. Though formulated differently, the historian Abdellah Laroui moves forward a similar idea. This last differentiates the traditions of politics of traditionnalisation. Politics of traditionalisation is group of speeches and political programmes followed by ruling elite with the intention of determining it which would be or would be considered as "traditions". In contrast, traditions are the acceptance chosen and aware of past by the citizens. And this acceptance is possible only when progress co-exists at the same time as traditions, that is to say when the institutions of the State allow to the citizens to choose between progress, traditions or quite other agreement between modernity and traditions. In other words, these institutions guarantee the access of the citizens to the ideological currents of their time, the free mouvement of progressive ideas and respect for civil liberties and individual. In the absence of this progress, there are only unconscious traditions, that is to say traditions which were produced by a politics of traditionalisation. And threatened in its ancient privileges, the ruling monarchy recreates traditions and forces the citizens to act in a traditional way. One of the pillars of this politics of traditionalisation is the deprivation of education and of knowledge at the citizens. In this respect, let us remind of the words of the king Hassan II pronounced during a television speech, following student riots of March 23rd, 1965 in Casablanca: «Allow me to say you that there is not such a serious danger as the State as that represented by an alleged intellectual. It would have better been worth that you are illiterates. It is openly said; and since, the politics of the systematic sabotage of the public educational system follows methodically. It is in the context of this sabotage that the government, towards the end of the seventies, started a politics of Islamization of the educational system. The sociologist Marnia Lazreg differentiates the Islam of politics discussed Islamization. Spirituality raises personal faith, while Islamization politics colonizes the public and private areas by stocks and codes of behaviours meant to be representative of national religio-cultural heritage. But being anachronistic, these stocks and codes are foreign to the daily experiments of the citizens. So, further to Islamization politics led by ruling elite, the official version of Islamic studies becomes a compulsory discipline from the beginning of the eighties. At the same time, the study of thinking disciplines, such as philosophy and sociology, is abolished except in two universities. Moreover, the school textbooks transport reducing pictures of the women where they are seen, indeed, subjected, ignorant and irresponsible. The purpose of this article is not to examine in an exhaustive way the Moroccan educational system, but let us mention only lastly that according to a recent report of the UNESCO, Morocco is among the worst countries in the world in education. Besides this educational deficit, the methods of education – especially in state schools – are archaic. Based on memorisation, they are advantageous for indoctrination, for standardization, for dogmatism and for destruction of any analytical mind. Moreover, the translated books are rare. In other words, the majority of the citizens do not have access to last social, human and scientific knowledge produced in the planetary ladder. Some people could retort that Morocco is not a rich country; and therefore, the State would not have necessary means to give a quality education to all children of the kingdom. In reality, it is not both about lack of means and of political choice. This country spends astronomic sums yearly to support an army, to buy highly sophisticated military equipment and to finance intelligence services and surveillance futuristic. Between other examples, further to the uprisings of 2011, Morocco spent, in a plan named Popcorn, two million American dollars (19,4 millions of dirhams) on the acquisition of facilities of electronic surveillance to the French firm Amesys, to spy as a whole on electronic mails and on other communications by Internet on the scale of the country entirely. Let us open a parenthesis here by noticing that this France which is meant to be a model of democracy, of human rights and of progress has no scruple to sell electronic facilities allowing police regimes to watch their citizens, to intimidate them and to punish them at the need. Having said that, the fault of the educational system in Morocco is not due to a problem of resources, but, once again, to a political choice. Of course, the country counts a privileged class, from which the children benefit from a quality education in schools deprived of the country, then in big universities abroad. However, sharing interests socioéconomiques with ruling elite, this fringe of the population tends in general to be favourable to social status quo. Therefore, put to one side this favoured class, force is to note that the State follows a politics of illiteracy disguised of the citizens. And no people deprived of education and knowledge can look at his culture with a critical attitude, with the intention of analysing it, renewing it and registering it in ideological currents in his/her time. The prohibition of the culture of human rights. The politics of deprivation of education and of knowledge aims at congealing the Moroccan citizens in cultural opposition to change. However, the anachronistic culture which results from it is promoted as a national culture. This explains that ruling elite forbids any speech which could destabilise its control on the definition of culture, traditions and of religion of the country. As at present the culture of the rights of the person represents the main risk of destabilization of regime in place, ruling elite follows a double strategy. On one hand, she appropriates any politics relating to human rights and, on the other hand, she suppresses the society and the activists who work in domain. In this respect, the current politics of the king Mohamed VI is in the continuity of his precursors. Indeed, let us remind that on November 18th, 1955, the king Mohamed V asserts the membership of the State of Morocco in the principles of the Universal Declaration of Human Rights in his speech celebrating the independence of the country. In 1962, the preamble of the first Moroccan Constitution reasserts the membership of the country to the United Nations. Later, the constitutional reforms of 1992 introduce in an explicit way the concept of human rights into preamble. Besides, during she which took place in Vienna in 1993, Morocco reasserts its membership in human rights and in principle of the universality of these rights. With the reforms of 2011, Constitution dedicates a whole chapter to freedom and basic rights. Moreover, except for some protocols, the State of Morocco ratified the totality of treaties relating to the protection of basic rights. Finally, in 2014, the country welcomed the worldwide Forum of human rights in Marrakech. However, if Morocco seems not to miss its appointment with the modernity in human rights, reality is far from being also famous. Already in the context of independent Morocco, Mohamed V adopts a politics of multiparty system. Such step parried democratic as much as it seems to respect the multiplicity of citizen's voices. In reality, this multiparty system turned out to be a way «to divide to reign better». The still united, Popular Front with anticolonial struggles, worked at the implementation of social, economic and political reforms of wingspan under the aegis of the big party Istiqlal (the Independence). And by encouraging any small group to become a political party, Mohamed V broke up the popular union. Also he recovered the political opponents by linking them to the government, on one hand, and punished the incorruptible of them by excluding them for political game, on the other hand. He was so for the government of Abdallah Ibrahim, dissolved in 1960, because this one worked at the institution of a democratic regime in the country. Besides, after the decease of Mohamed V, his successor Hassan II adopted a hard line by reserving a politics of’ "destruction" in form of censure, of forced disappearance, of torture, of excessive imprisonment, of banishment, or even of assassination to the thinkers and activists who persevere in showing that there are other options in monarchal regime. The main victims of such destruction politics were the left or extreme left activists who worked at the advent of a socialist regime in Morocco in the seventies. Besides, the Moroccan movement of human rights was born in the context of these highly repressive politics. For example, the precise origin of the creation of the Moroccan Association of human rights (AMDH) goes back up in 1979, after a series of waves of excessive arrests, serious attacks to the physical integrity of the citizens and of trial of mass indicting hundreds of socialist or Marxist activists. By adopting for main referent the concept of universal rights, this new political actor works at the change of the reports of power between citizens and ruling elite. His activities include the denunciations of the violations of human rights in the country – and elsewhere, the organisation of sit-in and of demonstrations, the keeping of conferences of education, of information and of conscientisation in human rights, and the organisation of holiday camps for the young people aiming at educating rising generations in the culture of human rights. And although these speeches and activities are completely peaceful, the members of the Moroccan movement of human rights in general, and those of AMDH especially, are regularly the object of harassment, of surveillance, and sometimes even excessive arrests and physical attacks. Besides, this state vise narrowed more with the Moroccan Spring. Since July, 2014, the activities of AMDH are systematically forbidden. Besides the ban of some speeches and activities of the Moroccan movement of human rights, censure influences jobs of journalists, thinkers, activists and artists who question current structures of power. If that's how it is for Maria Moukrim, Ali Anouzla, Maâti Monjib and Nabil Ayouch, among others. Let us add here that if the film-maker Ayouch did not attack structures of power in the classical sense of term in his censored film Much Loved, he however researched the economic marginalization which forces the women to prostitute itself. By calling into question hierarchies established between sexes, it ran the risk of censure. Some stories raise the question of representation, in the sense which neither thinking elite nor Moroccan movement of human rights would represent ideals of the crushing majority Moroccan population. And such stories skip that thinking and militant elites constitute a minority in the almost totality of societies. And it is these elites which work to spread knowledge as well as culture of human rights within the social cloth. By censoring speeches and activities of these elites, the Moroccan State hinders in an efficient way the spread of the culture of human rights within the population. Result, the citizens are deprived of right to rethink structures of the power of their country, to bring some change in their culture and to register human rights there. Alas, the manufacture of cultural opposition to change raises outright deliberate political programmes. Impunity: a political choice. Let us mention finally that impunity plays a primordial role in the manufacture of the cultural opposition to change from which the Moroccan people suffer. If the justice system was independent, the cultural rights of the citizens, and more precisely the right to education and to access to knowledge and the right to expression freedom, would not have been able to be systematically violated. Certainly, as any country with democratic window, Morocco has laws, magistrates and courts. The country even instituted l’ (IER) in 2004. Besides, it is the examination of the specificity of this committee which gives information about the double political game of ruling elite. In general, the committees of the truth and of reconciliation are instituted following a change of power. However, as freedom is indivisible, this internalised fright hits all public spheres, among which intellectual production, artistic creation and union, partisan and professional organisations. Conclusion. The analysis of the Moroccan political stage shows that ruling elite appropriated the institutions of the State. Far from dedicating a right State, the Constitution, for example, codifies the absolute power of the monarchy. State politics therefore does not care about progress of the nation, about collective interest and about ease of the citizens and of the citizens.
